The client must read and agree to these terms prior to commencement of the commissioned piece.
Copyright & Usage
I (Melinda Zielfelder) retain full copyright on all artwork that is produced, including mock-ups and prints. When a client commissions a painting, I reserve the right to display that painting on my website, through social media, and in marketing materials at my discretion.
Lead-Time
Since it takes some time to complete a painting, I may have a client waiting list. At the time the deposit is received, clients will be advised approximately what date I will begin working on mockups to provide for their approval.
Once the final mockup is approved, paintings can take between 2 and 8 weeks to complete, depending on size and complexity. At the time that the project scope is established, a completion date will be set and the client will be notified. Shipping time is not included in the lead-time, and can take up to 2 additional weeks, depending on the client’s location.
Deposit
A $50.00 non-refundable deposit is required to secure the client’s place in the waiting list. Paintings will not be deemed as ordered until the deposit has been received.
Payment
The remaining final balance will be invoiced upon completion and approval of the painting and must be paid in full prior to the client’s painting being shipped.
Payments can me made securely through Paypal.
Cancellations
If, after the client has paid the deposit, they decide not to proceed with the commission, they have 7 days from the date that the deposit is paid to notify me in writing that they do not wish to proceed. At that time, they will receive a full refund of their deposit. Upon cancellation, clients will lose their place in my waiting list.
If clients cancel their order and 7 days have passed since placing the deposit, the full deposit amount will be retained as loss of business, to cover my time, administration, emails, mock-ups, and payment fees. Any additional payment made by the client will be refunded in full.
Changes and rejection of finished painting
On receiving an approved painting, clients have 7 days to contact me about any required changes. If the painting needs to be returned for alterations, the client will cover the necessary shipping charges both ways.
If the client is still not happy with the finished painting after changes have been made, clients will receive a full refund minus the deposit plus 25% of the balance. The refunded amount will be paid after the painting has been returned to me.
Damage in Transit
My paintings are packaged extremely well, however in the unlikely event that damage occurs during transit the client must email me a photo of the damaged artwork as well as a photo of the condition of the packing materials immediately. The artwork must be returned to me and a new painting will be completed at no cost. The new painting will be added to my client waiting list.
Privacy Policy
The artist will not sell, distribute or lease the client’s personal information to third parties.
